Does make you wonder how White River Productions will do. They've been picking up publications that were ceasing operations for several years now. This is Jim Eudalys son, so I they do well.

Well, that's a big maybe and complete dependent on what type of agreement the publication uses. It's rare that actual ownership of copyright is transferred but rather exclusive right of publication is generally put into place.

Wouldn't you say that if the magazine traveled to the layout and took the photos used in the magazine presentation that the photos were theirs, but that if the hobbyist took the photos himself which were published in a
magazine, the proprietary rights stay with the owner of the layout , right?

Isuspect that to have your photos published you have to give up proprietary rights

Again, that depends on the agreement that the publication uses, but as far as I know in most cases you retain copyright while they obtain exclusive publication rights and only copyright on that actual publication.

I have first-hand experience regarding several layout photo shoots. Photos from my first shoot ran in Model Railroader in 2006, including on the cover. That first contract gave MR single-use rights to use but did not transfer copyright ownership. In more recent contracts K received full copyright ownership. In every case I had a prior relationship with the layout builder(s) so I wasn't a "hired gun."

In my experience contracts transferring copyright ownership started about the time that digital photography, and a potential of digital delivery, started to become viable. That included another cover and a single photo 2-page spread for the benefit of a local museum.

One doesn't get rich selling photos to hobby magazines. My effective hourly rate was really low, but I was glad to promote the hobby and individual layouts/museums. My compensation partially paid for new photo gear I bought. And it is not unusual for a photographer to receive more compensation per square inch and overall than the layout owner who pens the words.

A friend who once worked for another model magazine said that the special-topic books can be where publishers make their biggest money, not on the monthly magazine itself.

It also has always been an "unwritten law" that photos/articles offered to one magazine should never be offered to another. In my book that would be a matter of "bad faith", which could get one blacklisted as an author or photographer.

I understand why one might grow impatient. MR has perhaps a decade of HO layout articles, some of which are published well after the demise of the builder.

It doesn't take a genius to understand why two different magazines would not like to publish the SAME article. I would think they (the magazine) would spell that out to potential authors VERY clearly. As for articles appearing a decade later. maybe there should be a time limit imposed, as in if the article is not published by such and such, the author has the option of re-marketing it. Especially if they need funeral expenses! :lol: :lol: :lol: :lol:

Got to re-reading this topic, and am sort of intrigued by the "decade" of articles thing. Guessing that would mean on the order of 120 articles???? On the basis of one article of a type per issue.

Quite a few years ago I did see what was effectively the same article in both OSN and RMC which produced considerable head scratching on my part since from my experience sending the same article to 2 publications was always something that simply not done. I can also recall a letter to the Ed. in OSN regarding their publishing photos of a layout that they took while on an open house tour w/o permission.

If money has not changed hands and no agreement has been signed, an author simply should notify the editorial office that they wish to withdraw their article from consideration; not an e-mail - actual certified mail.

What is particularly interesting is that all these "BOOK" dealers try and jam Kindles and Nooks and whatevers down your throat, instead of printed books, while vendors of various products bombard you with printed catalogues, even when one does all of their transactions with same via the Net. I don't know the economics, but it must be waaaay cheaper to do a catalogue opposed to a book, because catalogues are prolific, while it appears they are trying to make the printed book extinct.

A paper catalogue every 6 months to a year would be good but i don't need one every two weeks. and I don't need an advertising E-mail every 5 seconds.

When they do away with printed books, I am DONE reading. I could rant on, but you're bored already! :mrgreen: :lol: :lol: :lol:

Rather like my Kindle as it works for several of my e-mail accounts, the internet, and plays both my internet raio streaming and music that I've bought. Has had zero impact on my holding a real book.
